The chairman and founder of the association was Alexander Silchenko, founder and executive director of OOO SZK Infosvyaz (Stream Telecom - a service for marketing mailings by mail and in messengers). Yulia Rozhkova, CEO of the email marketing service OOO Pismo (email distribution service) Dashamail and founder of the association, explained that the creation of the association was due to the tightening regulation of companies that collect and process user data.
In Russia, general liability for leakage of personal data has been established in accordance with Article 13.11 of the Code of the Russian Federation on Administrative Offenses; the fine for violation is no more than 300 thousand rubles for legal entities.
In 2022, a procedure for notifying about leaks to Roskomnadzor (RKN) and the State System for Detecting, Preventing, and Eliminating the Consequences of Computer Attacks on Information Resources of the Russian Federation appeared. Then new rules for cross-border data transfer appeared - companies must also notify Roskomnadzor about this. Certification of a personal data specialist appeared, as well as a requirement for the transfer of biometric PD to the Unified Biometric System.
In addition, the State Duma of the Russian Federation is considering a bill that introduces turnover fines for data leaks.
